DMCA Policy

1. Overview

UtopiaHub respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond promptly to claims of copyright infringement committed using our Service.

2. Filing a DMCA Takedown Notice

If you believe that content hosted on or distributed through UtopiaHub infringes your copyright, you may submit a DMCA takedown notice containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the infringing material and information reasonably sufficient to locate the material on our Service.
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

3. Submitting a Notice

DMCA takedown notices should be submitted through our Discord server by opening a ticket in the support channel. Please include "DMCA Takedown" in your ticket subject for faster processing.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

5. Repeat Infringers

UtopiaHub reserves the right to terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from the Service more than twice.

6. Good Faith

Please be aware that filing a false DMCA takedown notice may result in legal liability. Before filing a notice, please ensure that the content in question actually infringes your copyright. Misrepresentation of a claim can result in liability for damages, including costs and attorney fees.
